1. Acceptance of Terms

Welcome to PodPulsar ("Service", "Platform", "we", "our", "us"). By creating an account, logging in, or using any feature of PodPulsar, you ("User", "Creator", "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not access or use PodPulsar. These Terms constitute a legally binding agreement between you and PodPulsar. By clicking "I Agree" within the application, you are providing your electronic acceptance of these Terms.

If you are using PodPulsar on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

PodPulsar is an AI-powered podcast creation platform that enables registered users to generate podcast scripts and audio content using artificial intelligence language models and text-to-speech systems. Our Service includes:

• AI-powered script generation from user-provided content
• Text-to-speech audio synthesis in multiple voices and languages
• Podcast hosting, RSS feed generation, and distribution tools
• Analytics, scheduling, and content management features

We provide tools — we do not create, review, moderate, or endorse any user-generated content. PodPulsar is a neutral technology platform.

3. User Responsibilities & Content Ownership

You are solely and entirely responsible for all content you create, generate, publish, or distribute using PodPulsar, including but not limited to:

• All content generated by AI based on your inputs and prompts
• Scripts, audio files, and published podcast episodes
• Episode titles, descriptions, and metadata
• Any third-party content you incorporate into your podcasts
• Content published to RSS feeds, podcast directories, and external platforms

You retain ownership of original content you create. However, by using PodPulsar, you grant us a limited, non-exclusive, royalty-free licence to process, store, and deliver your content as necessary to provide the Service.

PodPulsar provides a technology tool. The legal, ethical, and moral responsibility for what you create and publish rests entirely with you. We are not a publisher, broadcaster, or content creator.

4. AI-Generated Content Disclaimer

Content generated by PodPulsar's AI systems — including scripts, narratives, and spoken audio — is produced by machine learning models and may contain:

• Factual inaccuracies or hallucinated information
• Unintentional bias, stereotypes, or misleading statements
• Outdated information
• Content that sounds authoritative but is incorrect

By using PodPulsar's AI generation features, you acknowledge these limitations and accept full responsibility for reviewing and verifying all generated content prior to publication.

5. Copyright & Intellectual Property

You represent and warrant that:

• You own or have the legal right to use all content you submit to PodPulsar as source material
• Your published content does not infringe any third-party copyright, trademark, patent, trade secret, or other intellectual property right
• You will not use PodPulsar to reproduce, distribute, or publish copyrighted material without proper authorisation from the rights holder
• You will not submit content designed to generate scripts that plagiarise or closely mimic existing copyrighted works
• You will not use our platform to create content that falsely attributes authorship or impersonates creators

PodPulsar complies with applicable copyright laws including the Digital Millennium Copyright Act (DMCA) and equivalent legislation in other jurisdictions. We will respond to valid takedown notices submitted to [email protected]. Accounts found to repeatedly infringe intellectual property rights will be terminated.

PodPulsar's own platform, software, branding, and underlying technology remain the exclusive intellectual property of PodPulsar and may not be reproduced, reverse-engineered, or used without express written permission.

6. Prohibited Content & Uses

You may not use PodPulsar to create, generate, publish, or distribute content that:

• Is defamatory, fraudulent, deliberately misleading, or constitutes libel or slander
• Incites violence, hatred, or discrimination against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic
• Contains sexually explicit, pornographic, or adult material
• Promotes or facilitates illegal activities of any kind
• Impersonates real individuals, celebrities, public figures, brands, or organisations without clear authorisation or satirical context
• Spreads medical misinformation, scientific falsehoods, or politically manipulative content
• Constitutes spam, phishing, or unsolicited commercial communications
• Violates the privacy of any individual, including sharing personal information without consent
• Is designed to harass, bully, or intimidate any person
• Violates any applicable local, national, or international law or regulation

You also may not:

• Use PodPulsar to scrape, harvest, or collect data from the platform
• Attempt to circumvent usage limits, access controls, or security measures
• Resell, sublicence, or commercialise access to PodPulsar without our written consent
• Use automated systems to generate content at scale in violation of fair use policies

7. Limitation of Liability & Indemnification

To the fullest extent permitted by applicable law, PodPulsar, its directors, officers, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to:

• Content you create, publish, or distribute using the Service
• Any claims, lawsuits, or legal proceedings brought by third parties against you relating to your content
• Inaccuracies, errors, or omissions in AI-generated content
• Copyright infringement, defamation, or other intellectual property claims resulting from your use of the Service
• Service interruptions, downtime, data loss, or technical failures
• Unauthorised access to your account or content

Indemnification: You agree to indemnify, defend, and hold harmless PodPulsar and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you create or publish using PodPulsar.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to PodPulsar in the three months preceding the claim.

8. Account Termination

PodPulsar reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without prior notice, for:

• Violation of any provision of these Terms
• Publishing prohibited or illegal content
• Abusive, fraudulent, or harmful use of the Service
• Non-payment of applicable subscription fees
• Any other reason we deem necessary to protect the platform or its users

Upon termination, your right to access and use the Service ceases immediately. We may delete your content and account data. You may request a data export before termination by contacting [email protected].

You may terminate your account at any time by cancelling your subscription and contacting us. Termination does not entitle you to a refund of any prepaid subscription fees except where required by applicable law.

9. Changes to Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes:

• We will notify you within the PodPulsar application
• We will require you to re-read and re-accept the updated Terms before continuing to use the Service
• The updated Terms will include a new version number and effective date

Continued use of PodPulsar after accepting updated Terms constitutes your agreement to the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes, controversies, or claims arising out of or in connection with these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.

If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the competent courts of the jurisdiction in which PodPulsar operates. You waive any objection to the exercise of jurisdiction over you by such courts.

Nothing in these Terms limits your rights as a consumer under applicable consumer protection laws in your jurisdiction.
